SimSportsNet Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the SimSportsNet website, apps, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use SimSportsNet.

1. About SimSportsNet

SimSportsNet is an online platform for organizing, tracking, and managing competitive video game leagues and teams (for example, NBA 2K Pro-Am and other supported titles). The Service allows users to create profiles, form or join teams, schedule and record matches, and participate in leagues and events.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use SimSportsNet. If you are under the age of majority where you live, you may only use the Service with permission from a parent or legal guardian who agrees to be bound by these Terms on your behalf.

3. Account Registration and Security

You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@simsportsnet.com if you suspect any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Harass, threaten, abuse, or harm other users.
Post or transmit any content that is illegal, fraudulent, defamatory, obscene, or otherwise objectionable.
Impersonate any person or entity or falsely represent your affiliation.
Attempt to gain unauthorized access to the Service or other users’ accounts.
Interfere with the operation of the Service, including via bots, scripts, or automated means, except as explicitly permitted by us.
Reverse engineer, decompile, or attempt to derive the source code of any part of the Service.

5. User Content

You are responsible for all content you submit or upload to SimSportsNet, including team names, logos, chat messages, match results, and other materials (“User Content”).

By submitting User Content, you grant SimSportsNet a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute that content as reasonably necessary to operate and improve the Service.
You represent and warrant that you have all rights necessary to submit the User Content and that it does not infringe any third-party rights.
We may remove or modify User Content at our discretion if we believe it violates these Terms or applicable law.

6. SMS Messaging and Phone Numbers

SimSportsNet may offer optional SMS text messaging for certain notifications, including but not limited to:

Team invitations and join links
Roster changes and team updates
Match reminders and schedule changes
Important account-related alerts

6.1 Opt-In

You will only receive SMS messages from SimSportsNet if you explicitly opt in via your account settings. To opt in, you must:

Log in to your SimSportsNet account.
Navigate to your Profile or Notification Settings.
Enter your mobile phone number in the designated SMS field.
Check a consent box acknowledging that you agree to receive SMS messages from SimSportsNet related to your teams, leagues, and account.
Save your settings.

6.2 Opt-Out

You may opt out of SMS messages at any time by:

Replying STOP to any SimSportsNet text message, or
Updating your account settings to disable SMS notifications and/or remove your number.

After opting out, you may continue to receive necessary service or legal notices through other channels such as email or in-app notifications.

6.3 Message & Data Rates

Message and data rates may apply, depending on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages.

6.4 Phone Number Use

We use phone numbers only to provide SimSportsNet-related services as described in these Terms and in our SMS Messaging Policy. We do not sell users’ phone numbers. For more information on how we handle personal information, please see our Privacy Policy.

7. Third-Party Services

The Service may integrate with or link to third-party services such as console networks, streaming platforms, or communication tools (for example, Discord). These third parties are governed by their own terms and privacy policies, and we are not responsible for their actions or content.

8. Intellectual Property

SimSportsNet, its logos, trademarks, design, and software are owned by SimSportsNet or its licensors and are protected by intellectual property laws. Except as expressly allowed in these Terms, you may not copy, modify, or distribute any part of the Service without our prior written permission.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, SimSportsNet and its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of (or inability to use) the Service.

Our total aggregate liability for any claims arising out of or relating to the Service will not exceed the amount you have paid to us for the Service in the six (6) months preceding the claim (or US $0 if you have not made any such payments).

11. Indemnification

You agree to indemnify and hold harmless SimSportsNet and its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Service;
Your violation of these Terms;
Your violation of any third-party rights, including intellectual property or privacy.

12. Changes to the Service and Terms

We may update or modify the Service at any time, including adding or removing features. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date below and may provide additional notice where appropriate.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the Service. You may stop using the Service at any time and may request account deletion as described in our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SimSportsNet is primarily operated, without regard to its conflict of law principles.
